Chevron files appeal of Richmond refinery ruling

SAN FRANCISCO, July 20 - Chevron Corp (CVX.N) filed an appeal on Monday of a ruling that stopped work on a new hydrogen plant at its refinery in Richmond, California, the oil company said.

Chevron had said earlier this month it planned to appeal a judge's ruling that halted the $1 billion project at the 107-year-old San Francisco Bay area refinery, which is Chevron's oldest. [ID:nN09461350]

Contra Costa County Superior Court Judge Barbara Zuniga ruled this month that the environmental impact report filed to get construction permits for the new hydrogen plant failed to detail how it would change pollution levels from the refinery.

"We believe there is ample factual and expert evidence, as well as law, supporting the Environmental Impact Review and the project," refinery manager Mike Coyle said in a statement.

Work started last September on the plant, which is being built by industrial gas supplier Praxair (PX.N) and would ship excess hydrogen to nearby refineries owned by ConocoPhillips (COP.N) and Royal Dutch Shell Plc (RDSa.L) through a new pipeline.

Chevron said the project's future remains "in question" until the California State Court of Appeal can decide the issues.

The case was "Communities for a Better Environment v City of Richmond" in the Contra Costa County Superior Court of California, case no. MSN08-1429.
