Yesterday Haidian District People's Court concluded a lawsuit on trademark infringement disputes between 361 Degree and Kuazu Sportswear Co., the court issued the judgment to order the Kuazu Sportswear Co. to stop all acts of infringement and compensate for losses of 8000 yuan.
361 Degree Co. claimed they own the exclusive right of Trademark of 361 Degree (registered code: No: 3576467) on production of sports shoes, companies without the authorized to sell the products with brand of 361 Degree will violate the exclusive right of trademark. In last October 361 Degree found the faked sports shoes bearing brand of 361 Degree sold by Kuazu Sportswear Co. and appealed to the court and asked the infringer to stop the sales and compensation of losses of 50,000 yuan.
Kuazu Sportswear Co. agreed with the first claims appealed by 361 Degree, but refused the second because they say their sales are made by 361 Degree.
With careful examination on the shoes sold by Kuazu Sportswear Co. the court believed the evident supporting 361 Degree because differences are found between the shoes made by 361 Degree and sold by Kuazu Sportswear.
