On March 29 the Legislative Affairs Office of Guangzhou Municipal Government and the Legislative Affairs Office of Foshan have jointly issued the Notice on Establishing the Management and Cooperation Mechanism for Administrative Legislation and Regulatory Documents in Guangfo Ciyt. This Notice establishes the mechanism for the management and cooperation administrative legislations and regulatory documents.
According to the notification, the two cities will work together to draft the relevant laws, regulations and regulatory documents,and then jointly issue the regulatory documents for the purpose of sharing the management information of administrative legislation and regulatory documents; and will regularly check up laws, regulations and regulatory documents.
The notice requires that once the respective laws, regulations and regulatory documents of one city involve the economic and social affairs management of the other, or are closely related to the interests of the residents or social organizations of the other party, the draft party should take advice from the other, whose government organizations, upon receipt of the exposure draft, should organize to seek for opinions from their government departments, grass-roots government organizations, residents and the social organizations.
The regulatory documents with the developments and cooperation of the Guangfo City as to the main contents shall be jointly released by the governments or the government offices of the two cities or, upon the approval of the two governments, issued jointly by the legal organizations of the two cities.
The notice requires that if the normative local laws, regulations and regulatory documents of one party are challenged by the government departments, grass-roots governments, residents and the social organizations of the other, the legal organizations of the two governments should coordinate together, and propose timely solutions in accordance with the procedures of legislation and regulatory document management and therefore respond fully to the concerns of the dissenter.
