According to the introduction by the lawyer--Li Xinyu who is specializing in the operation of Customs Law and comes from Shanghai representative office of Stein Shostak Shostak Pollack&O'Hara.LLP(SSSPO), U.S. Customs recently seized a large number of counterfeits on Oakland port where is near California, San Francisco. These counterfeits violated the trademark rights of some famous brands such as Gucci, Prada, Jimmy Choo, Bulgari, Cartier, Chanel, Versace and Juicy Couture. It is estimated that the domestic value of these commodities is more than 620,000 U.S. dollars and the "manufacturer's suggested retail price (MSRP)" is close to 23,000,000 dollars. U.S. Customs official revealed that those counterfeits came from China, submitted on the manifests as luggage products and carried by the Kota Salam ship. Customs officers seized these goods when check-up the containers on May 9. The consigner wrapped smaller bags into a small box, and packed small boxes into a big package. In addition, some counterfeiting signs were hidden in the lining to avoid inspection. Some illegal American wholesalers will use counterfeiting signs on some cheap goods. Li Xinyu lawyer explained that in these administrative punishment cases of infringement intellectual property rights, U.S. Customs will count the fines based on the MSRP. As the large MSRP of nearly 23,000,000 dollars, the importers, business leaders and other related enterprises are maybe unable to pay huge fines and become insolvent. Because of the serious circumstantialities, U.S. government also may institute criminal litigation in allusion to related individuals.
