Microsoft Sues Motorola for Charging Excessive Patent Royalties

Microsoft Corp. sued Motorola Inc. on Tuesday, alleging Motorola charged "excessive and discriminatory" royalties for some patents used in Microsoft's Xbox gaming console, U.S. media reported.

Microsoft said it has filed an action in the U.S. District Court for the Western District of Washington in Seattle, arguing that Motorola breached its commitments to standards organizations to license patents related to wireless and video coding technologies under reasonable and non-discriminatory terms and conditions.

"These commitments are designed to benefit all parties that rely upon these standards, and Microsoft has been harmed by Motorola's failure to honor them in recent demand letters seeking royalties from Microsoft," the All Things Digital technology blog quoted a Microsoft spokesperson as saying.

It was Microsoft's second lawsuit against Motorola in a little over a month.

On Oct. 1, the software giant filed a suit against Motorola for infringement of nine Microsoft patents by Motorola's Android-based smartphones.
