THE Hong Kong driver whose truck dragged and killed a 4-month-old baby in a stroller in April was sentenced to death suspended for two years.

The Hong Kong driver Liang Guanbiao, 32, appeared in court Friday charged with intentional homicide.

The Shenzhen Intermediate People s Court said Liang had done nothing to save the baby, Zhou Menglin, who was still alive in the stroller trapped under Liang s truck which knocked down Zhou s mother on Busha Road in Nanwan, Longgang District, on April 25. Liang fled to Hong Kong but later surrendered to Shenzhen police.

The court said it had imposed a suspended sentence because Liang had turned himself in to police and had compensated Zhou s family.

The court said many witnesses had verified the baby was still alive and some had told Liang the baby was alive, but he still fled. The baby was killed when he fell from the stroller as Liang drove to Hong Kong.

Police found the remains of the baby April 29 following a four-day search. Liang was arrested May 4 on charges of involvement in a hit-and-run and intentional homicide.

Liang s mother fainted on hearing the sentence. Liang said he would appeal.

Zhou s father Zhou Yigui and mother Li Yun accepted the verdict. The family said they would now take Liang s employer to court for compensation.

Professor Chen Zhengta at Shenzhen University Law College said the verdict was a little harsh. The prosecutors took Liang to court on a charge of indirect homicide and suggested a term of life imprisonment but this was rejected.
