A PRIMARY school pupil has appealed to the Shenzhen Intermediate People s Court claiming compensation of 7,600 yuan (US$1,151) ordered by a Longgang court was not enough to cover injuries suffered at her school.
The girl, identified as Xiao Ting, 10, said she had spent far more on treating her injuries. The private primary school in Longgang District had argued that it was not responsible for her injuries because they occurred when pupils were playing during a class break.
Xiao Ting broke two of her incisors when she was pushed over by classmates as they were returning to the classroom Oct. 24, 2008. She said her classmates were pushing each other and teachers had not called them to order.
Xiao Ting claimed her injuries were the result of a lack of care and responsibility by teachers to protect the safety of school pupils and demanded 11,000 yuan in compensation from the school.
The school argued, however, that the accident was caused by other pupils who should be held responsible.
The school also said the girl s medical expenses had been paid by an insurance company, so she was not entitled to seek double compensation from the school.
The Longgang District People s Court said it was the school s responsibility to protect pupils and ordered the school to pay Xiao Ting 7,600 yuan in compensation.
Both Xiao Ting and the school appealed the ruling in the intermediate court which was yet to hand down its decision.
