Negative ITC Injury Determination Terminates First CV Case against China

The International Trade Commission announced Nov. 20 that it has made final negative injury determinations in the ongoing antidumping and countervailing investigations of coated free sheet paper from China. As a result, no AD or CV duty orders will be issued with respect to these goods. The ITC made similar determinations concerning coated free sheet paper from Indonesia and Korea.

The CV case against glossy paper from China marked the reversal of a 20-year-old Department of Commerce policy against assessing CV duties on products from non-market economy countries. The ITA’s preliminary determination imposed CV duties of 10.90 percent to 20.35 percent against the subject imports. This action prompted China to file in September only its second-ever complaint against the U.S. in the WTO.
