THE Shenzhen Intermediate People s Court recently heard an appeal by a man claiming further damages for injuries he received in a fall in a gymnasium.
The man, identified as Luo, sued the Total Fitness Club over his accidental fall while working out Feb. 25. He claimed the fall was caused by a malfunction of the gym equipment.
Luo was knocked unconscious, causing concussion, and was hospitalized for eight days. He claimed 26,600 yuan (US$3,978) for medical expenses, psychological trauma and lost work and also a refund of 3,000 yuan in membership fees.
The Luohu District People s Court ordered the Total Fitness Club to pay Luo 15,000 yuan in the first instance. The judge said Luo fell backward and it must have been caused by an equipment problem.
The intermediate court is yet to hand down its decision.
