AN insurance company has appealed a Longgang court ruling over the share of compensation it was asked to pay to a pedestrian injured in a traffic accident.
PICC Property & Casualty Co. appeared at Shenzhen Intermediate People s Court on Wednesday to appeal a compensation ruling by Longgang District People s Court earlier this year over a traffic accident that involved 10 separate parties.
PICC argued that it should not have to pay 120,000 yuan (US$18,010) half the total compensation to the injured claimant, identified as Huang, as its client, a van driver identified as Shi, had only been partially responsible for the crash.
PICC also argued that it should not have to pay Huang s expenses or legal fees.
Huang said in court she hoped the court would uphold the original ruling.
Shi, PICC s client and a driver for a packaging company, struck a No. 668 bus on Shensha Road in Longgang District on Oct. 31, 2008. The bus, driven by a driver identified as Zhang, lost control and hit three parked cars, injuring Huang and several other pedestrians.
According to traffic police, Shi held the primary responsibility for the accident, while the bus driver Zhang s responsibility was secondary. Huang was hospitalized with a broken arm and leg and remained in hospital until May 2009. Her medical expenses of 82,000 yuan were paid by Shi s employer and the bus company.
Huang had originally taken five drivers and their insurance companies to Longgang District People s Court, demanding compensation of 249,900 yuan.
The Longgang court ruled Shi and Zhang should pay her a total of 240,000 yuan, while the other three drivers were not found to bear any responsibility.
The appeal continues.
