Part Compensation for Application

1. Compensation for Application

Compensation for the applicants: for the oversea applicants, 350,000 yuan (including taxes); for domestic applicants, 200,000 yuan (including taxes). But applicants who fail to submit application documents on time or submit application documents which are not in accordance with the requirements, thereby are disqualified, shall not receive the compensation from the Organizer.

2.Awards

There are 5 winning prizes. Applicants who received the winning prize will be invited to participate in the bid for the Conceptual Architectural Design of National Art Museum.

If the candidates who have got winning prizes choose to give up participating in the bid for the Conceptual Architectural Design of National Art Museum, compensation as stated above is available.

Part Intellectual Property Rights

1.None of the application documents submitted during this solicitation are to be returned.

2.Applicants enjoy the right of authorship. The permission of the organizer is needed before the applicants may appraise and demonstrate their works through mass media, professional journals, books or other ways.

3.Organizer has the right to use the submitted designs during the planning and designing of this project. Meanwhile, Organizer has the right to print, publish and exhibit the designs, through mass media, professional journals, books or other ways.

4.Applicants and Organizers will not use the designs submitted during this solicitation for anything other than this project.

5.Applicants shall make sure that the design documents submitted will not infringe upon the intellectual property rights (including but not limited to copyright, and patent right) of anyone within or outside of China, or proprietary technology, or trade secrets. Applicant shall guarantee that if the designs involve any other person's intellectual property right, or proprietary technology, or trade secrets, legal, valid and sufficient authorization should be acquired beforehand from the owners of the IPR. All the liabilities caused by the infringement of others IPR, or proprietary technology, or trade secrets, should be assumed by the applicants.

6.The various components of the solicitation documents (including verbal description, drawings and charts) are the fruit of the parties that participate in this solicitation. The Intellectual Property Right of this above-stated document belongs to the organizer and designing institutes involved. The applicants can only utilize the solicitation document for preparing the application document. Without Organizer s written permission, the applicants shall not use the above-stated documents for other engineering design or any other purposes; nor should the documents be leaked to any third party. Applicants who have leaked information or violate the IPR of the Organizer or the designers involved will be held responsible for any consequence caused by the inappropriate behaviors.

. INTRODUCTION

National Art Museum of China is Requesting for Proposals of the Conceptual Architectural Designs of National Art Museum of China(New Venue) that may demonstrate advanced design concepts, hoping to build the new National Art Museum of China(hereinafter referred to as the Museum ) into a state-level cultural architecture of high quality. Applicants from around the globe who have had experience designing cultural buildings, especially cultural buildings for exhibitions, are welcomed to submit the application for prequalification. The 20 applicants who pass the prequalification can submit their designs, from which The National Art Museum of China will select the top five excellent designs, whose applicants will be invited to tender for the design of the Museum.

Part . ELIGIBILITY AND QUALIFICATION OF APPLICANTS

1. The applicants shall be a legally registered entity;

2. Designing institutions within People s Republic of China should possess Level A license for Comprehensive Engineering Design or Level A license for architectural design;

3. Designing institutions outside People s Republic of China should be members of the local trade association, and possess qualifications to practice architectural design in the countries they are based in;

4.The applicants shall be experienced in designing projects with similar functions and nature;

5. This project will not accept the application of any consortium.

Part . OBTAINING OF PREQUALIFICATION DOCUMENT

The Prequalification Document can be obtained by the interested applicant in either of the following ways after submitting application forms:

Part . submission of prequalification application

The interested applicant shall deliver a printed prequalification application to the address of the Solicitation Agency before 12:00 on 29th October, 2010.

Part . OTHERS

1. The organizer of this solicitation for conceptual architectural design will compensate applicants who have passed pre-qualification and submitted effective schemes for the solicitation without being chosen as the winning designs in the end. Specifically, compensation for overseas applicants is RMB 350,000 (including taxes and international transportation fees), and compensation for domestic applicants is RMB 200,000 (including taxes).

Applicants of five winning designs will be invited to participate in bidding for the architectural design for the project of the National Art Museum of China. Sponsors will select the final bidders according to the evaluation results by the Bid Evaluation Committee and related regulations of the nation, and will grant design contracts accordingly; at the same time, the organizer will pay bidders who have not won the bid a certain amount of compensation.

2. Each application shall be submitted to only one project.

3. The prequalification per se and any related documents shall be governed only by the law of the People s Republic of China.
